Co-ownership process

The law of the 10th of July 1965 governs condominiums for which property is divided within several co-owners.

Every condominium lot is made of a private portion and a portion of the common area.

Co-ownership for a building requires to issue two main documents :

  • The division description document which identifies every lot and the thousandth fraction,
  • The property regulations report which describes the rules applicable within the condominium.

Co-ownership also requires a trustee and an individual account for the condominium.

The law ELAN dated November 2018 and its corresponding decrees enforces the necessity to fill legal vacuums and requires every condominium with superseeded property regulations to update its documents before November 24th 2021.
